Divorce law - Separation (UK)

marriage counseling

On rare occasions the UK Divorce Law grants divorce to a partner who has been "deserted". The category of Desertion or Separation covers cases where one partner "deserts" the other for a period of two years or more. The grounds for Divorce under Separation or Desertion is made difficult by the fact that this desertion, or Separation, would have to be continuous, and it has to be proven that the partner accused of desertion had actually intended on "deserting" his or her partner.

Divorce under this category is not very often granted, as it is very hard to prove the partner's intentions during the desertion or Separation. The Family Court of Law will require proof that a partner's intentions has been to wilfully desert a spouse, and that there is no question of the partner having been away for two years due to certain commitments, such as work, and just did not divulge it! So, ultimately it all depends on the "intentions" of the partner at the time of desertion. The period of desertion starts from the time that the intention of desertion is established.

Again, as with any divorce proceedings, if divorce becomes imminent then it is strongly recommended that each partner seeks legal representation and uses an experienced family divorce lawyer to minimise both financial and emotional heart ache at a later date. This especially applies to cases that may fall under the category of Separation or Desertion where intentions of the partner has to be proven and an experienced divorce lawyer will prove invaluable.
