Divorce Law - separation UK

On rare occasions the UK Divorce Law grants divorce to a partner who has been "deserted". The category of Desertion or Separation covers cases where one partner "deserts" the other for a period of two years or more. The grounds for Divorce under Seperation or Desertion is made difficult by the fact that this desertion, or Separation, would have to be continuous, and it has to be proven that the partner accused of desertion had actually intended on "deserting" his or her partner.

Divorce under this category is not very often granted as its very hard to prove the partner's intentions during the desertion or Separation. So, for example, the court would need to know if a partner had actually deserted the other, or was infact only a case of a partner being away for two years because of work and just didn't tell the other! So ultimately it all depends on the "intentions" of the partner at the time of desertion. The period of desertion starts from the time that the intention of desertion is established.
