Divorce Law - Washington (US)


There are several ways to get divorced in Washington state. The grounds for divorce are:

  • Annulment
    This is technically known as "Decree of Invalidity" and is granted in situations where the marriage is considered to be void because of a legal defect.
  • Separation and dissolution
    In Washington state, you do not need to prove grounds in order to receive dissolution of marriage. This can be done by one of the spouse must fill in the court summons and petition for the dissolution of marriage. The petition is then sent to the other spouse and they are given between 20 & 60 days to respond. The court will then provide temporary orders to guide the conduct between the parties while the divorce is becoming finalized. The final stage is where the court grants the "Decree of Dissolution of Marriage". The court will grant this on the ground that there has been irretrievable breakdown of marriage.

The assets are required to be divided equally between the spouse, regardless of who was at fault. Any child custody depends on what is in the "best interest" of the child. This can be either a joint or sole custody. In cases of sole custody, the other spouse will be given visitation rights.
